Do a search for Wes Montgomery - I can't believe that his stuff is usable! The recordings may not be commercial, but is it not still his playing and thereby his property? I'm confused. Thanks,

In the example of Wes Montgomery, the hits I get on that name show either covers by other performers, or possibly his recordings as part of the playlist of an archived radio show or podcast. It's possible that the podcasters or stations licensed his tracks for their broadcast program. However, I'd be skeptical that you could safely extract and reuse the tracks within one of these broadcasts, no matter what the rights designation the uploader may have selected. So that's the "caution" part.

Yup, that's it. I do want some commercial artists. If you search for Wes Montgomery on archive.org, there are a few recordings that are listed as Public Domain, but I find it hard to believe that I can use this stuff from such a well known and definitely commercial artist. Is it that they are live recordings and not album releases? Thank you!

i think you just don't understand. if the work is copyrighted, nothing can change this, it doesnt matter if you download it from here or rip from CD. you just can't use it, especially for your own commercial works.
